Swimming Pool Enclosures/Pool Safety

Please be advised that all swimming pools containing more than 24" of water must have a proper barrier and/or enclosure as required by the Massachusetts State Building Code.  This includes any inflatable pools with filters, available at most department stores.  If you have any questions please contact the Canton Building Department at 781-821-5003.

The Canton Building Department is a public safety office that enforces all applicable codes, laws and regulations to ensure all buildings and structures are constructed and maintained in a safe and usable manner. 

The department is comprised of:

Building Division/Zoning Enforcement 

Plumbing/Gas Division 

Electrical Division

The office staff can answer general information questions regarding, among other things, permits, the permitting process, Zoning Board of Appeals application process, general zoning questions, policies and procedures of the Building Department.  They also handle inspection requests for all the inspectors in the office.

Inspectors are usually available in the office Mon. morning ~ 9:00 am to 10:00 am and in the afternoon 3:30 pm to 5:00 pm. On Tues.-Fri. morning ~ 7:30 am to 8:30 am and in the afternoon 2:30 pm to 3:30 pm. They are available during these times to answer any questions regarding zoning, building construction, the building code and to take inspection requests.  Residential Inspections are handled Monday through Thursday, 3:30 - 5:00 p.m.

Work started without a permit or permission from the Building Inspector will be charged a

DOUBLE FEE.

 

If the licensed builder or homeowner requests an inspection and the work is not ready or the premises is locked or access to the premises is not accessible by means of a set of stairs or the work is unacceptable then a $50.00 RE-INSPECTION FEE will be charged to the licensed builder or homeowner and will be paid prior to rescheduling of the inspection.

 

Value of the proposed work includes carpentry, electrical, plumbing, gas and HVAC work.  The value of the work, including labor and materials, is based on fair market value.  If the Building Inspector determines that the value of the proposed work for any given permit is not based on the fair market value then the inspector will calculate the fair market value of the work using the most recent edition of the RS Means Catalog.  RS Means Catalog is used in the construction industry to determine the national and regional square footage and/or unit cost average for all phases of construction.

 

 

Building Division

The Building Division is responsible for ensuring public safety, health, and welfare insofar as they are affected by building construction. We enforce the Massachusetts State Building Code 780 CMR, the Massachusetts Architectural Access Board Regulations 521 CMR and any other applicable rules, regulations and laws related to building construction and safety. Building permits are issued through our office to construct, reconstruct, alter, repair, change occupancy to, demolish and move all residential and commercial buildings and structures within the Town of Canton. We also issue permits for swimming pools, fences, accessory sheds, temporary structures such as tents and trailers, solid fuel burning stoves and signs.

The following is a very short list of activities that do not require a building permit under the Massachusetts State Building Code 780 CMR:

  • One story detached accessory structure in which the floor area does not exceed one hundred and twenty (120) square feet.

  • Fences six (6) feet in height or less.

  • Retaining walls that are not a threat to the public safety, health or welfare and which retain less than four (4) feet of unbalanced fill. These walls are usually ornamental in nature.

  • Greenhouses covered exclusively with plastic film in accordance with St. 1983, c.671 . This exemption does not apply if the greenhouse is used for any other use or uses other than what is normally expected for this purpose.

  • Ordinary repairs which do not effect the structure, egress, fire protection, fire rating, energy provisions, plumbing, sanitary, gas or electrical systems.

The Building Division is responsible for performing site (when necessary), rough, insulation (when necessary) and final inspections on all building permits issued by this office. For new construction and additions we would also perform additional inspections to evaluate soil conditions, footings and foundation walls. These inspections are necessary to ensure that the work performed complies with the standards set forth in the Massachusetts State Building Code 780 CMR. We are also responsible for performing annual inspections to all schools, day-cares, churches, restaurants, function halls and other places of assembly to ensure that life safety items such as exit signs, emergency lights, exit doors and occupancy capacity are being maintained safely and properly.

Zoning Enforcement 

The Zoning Enforcement Officer is responsible for enforcing the Canton Zoning By-laws, MGL Ch.40A. These by-laws are used to control, among other things, density, parking, height and location of buildings and structures, uses of buildings and structures, requirements for buildable lots, signs, earth removal and overlay districts.

This office accepts, reviews and schedules hearings for all Zoning Board of Appeals applications. A hearing is required when an individual’s property or structure does not meet the requirements set forth in the Canton Zoning By-laws or the by-law dictates a certain approval is needed due to the scope of a project (i.e. Site Plan Approval, Special Use Permit, Standing Sign Permit, etc.).

One of the responsibilities of the zoning officer is to review structures for conformity to the zoning setbacks. When a new building or addition is constructed or perhaps a homeowner would like to install an accessory shed, a pool or a pool house on their property, they would first come to our office so that the zoning officer can review the location of the structure to make sure it meets the minimum setback distances for that zoning district. Whenever this is done, a certified plot plan is required showing the location of the new structure(s), to scale, on the plot plan.

Another responsibility of the zoning officer is to make sure the proper uses are maintained in the proper zoning district. If a new business comes into the Town or a homeowner wants to start a home-occupation business, they would first come to our office so that the zoning officer can determine if the use is allowed within that zoning district. If it is not, the individual may have to go before the Zoning Board of Appeals for a hearing.

The Plumbing Inspector enforces the Massachusetts State Fuel Gas and Plumbing Code 248 CMR 1.00-11.00 and any other applicable rules, regulations and laws related to plumbing and gas installation and safety. Plumbing and gas permits are issued through our office to install plumbing and gas systems and appliances in all residential and commercial buildings and structures within the Town of Canton.

The Plumbing/Gas Inspector is responsible for performing underground, site, rough and final inspections on all plumbing and gas permits issued by this office. These inspections are necessary to ensure that the work performed complies with the standards set forth in the Massachusetts State Fuel Gas and Plumbing Code 248 CMR 1.00-11.00.
